Terms of Service

These Terms govern your use of MS Host IT’s public website and control panel (the “Service”). By creating an account or using the Service, you agree to these Terms. If you use the Service on behalf of an organization, you represent that you have authority to bind that organization.

1. The Service

MS Host IT is a software delivery control plane that helps you manage VPS hosts, operate mediated terminal and file sessions, and (as features ship) deploy applications such as Node and React projects from sources you authorize, including GitHub. Features may be labeled as available, next, or coming; we do not guarantee that roadmap items will ship on a fixed date.

2. Accounts

You are responsible for safeguarding your login credentials and for activity under your account. Provide accurate information and notify us promptly of unauthorized use at support@mshostit.com.

3. Your infrastructure and content

You retain ownership of your code, configuration, and server infrastructure. You are responsible for:

• the legality and security of hosts you connect;
• credentials and GitHub authorizations you store or grant;
• reviewing deploy and remote actions before and after they run;
• complying with third-party terms (including GitHub’s) that apply to repositories and OAuth grants you use with MS Host IT.

MS Host IT mediates operations you initiate; it does not transfer ownership of your servers or repositories to us.

4. Acceptable use

You agree not to:

• abuse the Service to attack, scan, or harm systems you do not own or lack permission to operate;
• attempt to bypass encryption, session tickets, rate limits, or access controls;
• upload malware or illegal content through file or deploy features;
• resell or misrepresent the Service in a way that deceives others;
• interfere with other customers’ use of the Service.

We may suspend or terminate access for violations or to protect the Service and its users.

5. Third-party services

Integrations such as GitHub are provided by third parties. Your use of those services is subject to their terms and policies. We are not responsible for outages or changes by third parties that affect features that depend on them.

6. Availability and changes

The Service is provided on an “as available” basis. We may modify, suspend, or discontinue features with reasonable notice when practical. Pre-1.0 software may change more rapidly; we document user-visible changes in our public changelog.

7. Disclaimer of warranties

To the fullest extent permitted by law, the Service is provided “as is” without warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that deploys or remote sessions will be uninterrupted or error-free.

8. Limitation of liability

To the fullest extent permitted by law, MS Host IT and its operators will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or goodwill, arising from your use of the Service. Our aggregate liability for claims relating to the Service will not exceed the greater of amounts you paid us for the Service in the twelve months before the claim or one hundred US dollars (US $100), if you use only free features.

9. Indemnity

You will defend and indemnify MS Host IT against claims arising from your content, your servers, your misuse of the Service, or your violation of these Terms or applicable law.

10. Privacy

Our Privacy Policy describes how we handle personal and account data, including GitHub OAuth tokens.

11. Governing law

These Terms are governed by the laws applicable in the jurisdiction where MS Host IT primarily operates, without regard to conflict of law rules, except where mandatory consumer protections apply. Courts in that jurisdiction will have exclusive venue, except where prohibited.
